Terms of Service
Welcome to Brisbi. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Brisbi Inc. ("Company," "Brisbi," "we," "us," or "our"), a Delaware C Corporation. By accessing or using our website at brisbi.com, our web or mobile applications, our AI verification systems, Creator-led Pods, or any other features or services we provide (collectively, the "Platform"), you represent that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms in their entirety, you must not access or use the Platform.
Description of Service
Brisbi provides an execution infrastructure platform designed to help individuals follow through on their goals through daily accountability sessions, AI-powered verification of execution proof, a proprietary scoring system (the "Brisbi Score"), Creator-led accountability communities ("Pods"), journaling tools, and an AI Companion. The Platform operates as a technology infrastructure provider and does not provide medical, legal, financial, therapeutic, or mental health services of any kind.
Eligibility and Account Registration
2.1 Age Requirement
You must be at least eighteen (18) years of age to create an account or use the Platform. By registering, you represent and warrant that you are at least 18 years old. If we discover that an account has been created by a minor, we will terminate the account immediately and delete all associated data.
2.2 Account Accuracy
You agree to provide accurate, current, and complete information during registration and to update your information to keep it accurate. You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at support@brisbi.com if you suspect unauthorized access to your account.
2.3 One Account Per Person
Each individual may maintain only one active Brisbi account. Creating multiple accounts to circumvent the free verification trial, exploit promotional offers, or evade account restrictions is a material breach of these Terms and will result in the permanent termination of all associated accounts.
2.4 Google OAuth
You may register and log in using your Google account via Google OAuth 2.0. By doing so, you authorize Brisbi to receive your name, email address, Google account ID, and profile picture from Google. Your Google password is never transmitted to or stored by Brisbi.
Subscription Plans, Payments, and Billing
3.1 Subscription Tiers
Brisbi offers the following subscription tiers: Blueprint (free), Executor (paid), and Unstoppable (paid). Features available under each tier are described on our pricing page and are subject to change. Founding Creators are granted the Unstoppable tier as part of the Founding Creator Program described in Section 5.
3.2 Free Verification Trial
New users who are members of at least one active Pod are eligible for a seven (7) day free AI verification trial commencing from the date of account creation. Upon expiration, AI verification features are restricted to paid subscription tiers. The free verification trial is available only once per individual. Creating a new account to access a second trial period constitutes a violation of these Terms.
3.3 Pod Entry Fees
Some Pods charge an entry fee set by the Creator. Pod entry fees are processed through Stripe and are non-refundable unless required by applicable law.
3.4 Payment Processing
All payments on the Platform are processed by Stripe, Inc. By using the payment features of the Platform, you agree to Stripe's Services Agreement available at stripe.com/legal. Brisbi does not store your full credit card or banking details.
3.5 Subscription Billing
Paid subscriptions are billed in advance on a recurring monthly or annual basis. Your subscription will automatically renew at the end of each billing period unless you cancel prior to the renewal date.
Except where required by applicable law, all subscription fees and Pod entry fees are non-refundable. You may cancel your subscription at any time to prevent future charges, but no refunds will be issued for any partial billing period.
3.6 Fee Changes
Brisbi reserves the right to modify subscription fees. Any fee changes will be communicated to you via email at least thirty (30) days before taking effect.
Execution Sessions and AI Verification
4.1 Execution Sessions
The Platform allows you to set a daily mission statement, complete a timed execution session, and submit media evidence of your work ("Proof") for AI verification. Session data is recorded and used to calculate your Brisbi Score and streak.
4.2 AI Proof Verification
All Proof submissions are analyzed by our AI verification system powered by Google Gemini. The AI evaluates whether your submitted media constitutes genuine evidence of the stated execution task. The AI's determination — verified or rejected — is automated. Rejected submissions do not terminate your streak but do not award verification bonuses.
4.3 Presence Verification
Based on your account risk profile, you may be required to submit a selfie photograph alongside your Proof. The selfie is processed immediately by AI and deleted within seconds of analysis. No selfie data is stored permanently.
4.4 Prohibited Proof Submissions
You agree that you will not submit as Proof: (i) images or videos not created by you during the stated execution session; (ii) stock images, previously recorded media, or images of images; (iii) digitally manipulated or AI-generated imagery; (iv) media belonging to another person; or (v) any content that misrepresents your actual execution activity. Submission of fraudulent Proof constitutes a material breach of these Terms.
4.5 Community Flagging
Other users may flag your Proof submissions if they believe the submission is fraudulent. Flagged submissions are subject to AI re-review. If a submission receives three (3) or more flags and is confirmed as fraudulent, your account may be suspended.
The Founding Creator Program
5.1 Eligibility
The Founding Creator Program is an invitation-only program available to a limited number of creators selected by Brisbi Inc. during the platform's early launch period. Founding Creators are granted permanent Unstoppable tier access and the right to create and monetize Pods on the Platform.
5.2 Revenue Split
Creators who monetize their Pods through entry fees receive ninety percent (90%) of all gross revenue generated by their Pods. Brisbi Inc. retains a ten percent (10%) platform fee on all Pod revenue. Creator payouts are processed through Stripe Connect. Creators must complete Stripe Connect onboarding and maintain an active, verified payout account to receive payouts.
5.3 Creator Responsibilities
Creators are independent contractors and are not employees, agents, or representatives of Brisbi Inc. Creators are solely responsible for: (i) the content and quality of their Pods; (ii) compliance with all applicable laws; (iii) any tax obligations arising from their earnings on the Platform; and (iv) their conduct toward pod members. Brisbi does not guarantee any level of revenue or membership for any Creator.
Creator-Led Pods
Pods are accountability communities created and led by Creators. By joining a Pod, you enter into a relationship with the Creator of that Pod. Brisbi provides the technical infrastructure for Pods but does not control, endorse, or take responsibility for the content, activities, or conduct of any Creator or Pod.
When you join a Pod, your display name, execution proof media (subject to Pod settings), verified session count, and Brisbi Score may be visible to the Creator and other pod members. This visibility is an inherent feature of the accountability model and is a condition of Pod membership.
Brisbi is not a medical, legal, or mental health provider. Content from the AI Companion or Creators is for educational and motivational purposes only and is not a substitute for professional therapy, medical advice, or financial consulting.
The Brisbi Score System
The Brisbi Score is a proprietary metric calculated by Brisbi Inc. based on your verified execution sessions, consistency, streak performance, and trust record. The scoring methodology is subject to change at Brisbi's discretion. The Brisbi Score is displayed publicly on your Score Card and is not a guarantee of any outcome, qualification, or benefit outside of the Platform.
Fraudulent proof submissions, confirmed by AI review or community flagging, will negatively and permanently affect your Trust Grade and Brisbi Score. Fraud confirmations cannot be reversed.
AI Companion and Content
The Brisbi AI Companion provides automated responses based on your inputs and behavioral data for educational and motivational purposes only. It is not a substitute for professional medical, mental health, legal, or financial advice. You agree that you will not rely on AI Companion outputs for any decision that may have material consequences for your health, safety, finances, or legal rights.
You retain ownership of all journal entries and personal inputs you provide to the Platform. You grant Brisbi a limited, non-exclusive, royalty-free license to process, store, and use your inputs solely to provide and improve the AI Companion and Platform services. This license terminates upon deletion of your account.
Intellectual Property
All software, branding, user interface design, proprietary algorithms including the Brisbi Score algorithm, the execution framework, the AI verification system, and all other original content and technology on the Platform are the exclusive intellectual property of Brisbi Inc. and are protected by United States and international copyright, trademark, and trade secret laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal, non-commercial purposes. You may not copy, reproduce, reverse engineer, decompile, or use the Platform to build a competing product or service.
Account Suspension and Termination
10.1 Termination by You
You may delete your account at any time through your account settings or by contacting us at support@brisbi.com. Upon account deletion, your personal data will be deleted within 30 days, except where retention is required by law. Paid subscription fees are non-refundable upon account deletion.
10.2 Termination by Brisbi
Brisbi reserves the right to suspend or permanently terminate your account, with or without notice, for violations of these Terms, submission of fraudulent execution proof, creation of multiple accounts, abusive conduct toward other users or Creators, fraudulent payment activity, or conduct harmful to the Platform or its users.
Disclaimer of Warranties and Limitation of Liability
THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR UNINTERRUPTED OPERATION.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BRISBI INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF YOUR USE OF THE PLATFORM. IN NO EVENT SHALL BRISBI'S TOTAL CUMULATIVE LIABILITY TO YOU EXCEED THE GREATER OF (i) THE TOTAL AMOUNT YOU HAVE PAID TO BRISBI IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR (ii) ONE HUNDRED US DOLLARS ($100).
Indemnification
You agree to indemnify, defend, and hold harmless Brisbi Inc. and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Platform, your violation of these Terms, your violation of any applicable law, your submission of fraudulent proof, or your conduct within any Pod.
Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law provisions.
Any dispute, controversy, or claim arising out of or relating to these Terms or the Platform shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
YOU AND BRISBI AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.
Changes to These Terms
Brisbi reserves the right to modify these Terms at any time. When we make material changes, we will notify you by email at the address associated with your account and update the "Last Updated" date at the top of this document at least thirty (30) days before the changes take effect. Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the updated Terms.
